Experience

Brendan Monahan joined Babin Bessner Spry LLP as an Associate in 2018. Prior to joining the firm, Brendan practiced at a prominent securities litigation boutique, where he acted for clients in a wide range of litigation matters involving commercial disputes, securities regulatory investigations and prosecutions, corporate law remedies, and class action proceedings.

Brendan has appeared before the Ontario Superior Court of Justice, the Ontario Court of Justice, and the provincial securities commissions in Ontario and British Columbia. He has worked on matters at all levels of court in Ontario, as well as at the Supreme Court of Canada.

Brendan graduated from the combined J.D./M.B.A. program at Osgoode Hall Law School and the Schulich School of Business. While in law school, Brendan served as president of the J.D./M.B.A. student government. He also helped raise over $125,000 to fund a public interest bursary for Osgoode graduates who article in under-served communities. In 2015, Brendan and a teammate took home the Award for Best Factum amongst all respondent teams, nationwide, at the Harold G. Fox Moot.

Prior to law school, Brendan obtained his B.A. (Hons.) from Queen’s University, where he studied film and political science. Outside of law, Brendan enjoys travel, music, and trying new restaurants.

Representative Work

Brendan’s experience includes acting for:

  • A major Canadian retailer in a dispute in connection with certain easement agreements granting access over the retailer’s lands.
  • Directors of a closely-held company regarding a claim for an oppression remedy under the Canada Business Corporations Act.
  • A class of investors in a proposed class action against a multi-national mining company regarding secondary market liability under the Securities Act for alleged misrepresentations in the company’s public disclosure.
  • Various capital market participants in connection with the defence of securities regulatory proceedings.
  • An individual seeking declaratory relief against a former employer in relation to allegations of breach of contract.
  • Various creditors in proceedings under the Bankruptcy and Insolvency Act.
  • A Canadian hospitality company in a dispute concerning the validity and effect of certain franchise agreements.
